The U.S. Office of Government Ethics recently published a guide on Ethics and Procurement Integrity for government employees involved in the procurement and acquisition process. Although this guide is intended for Federal employees, it is also useful for government contractors to reference when dealing with procurement and acquisition workforce employees. For contractors with defined benefit pension plans, there is new guidance from DoD concerning the implementation of the Pension Protection Act of 2006. To see that guidance, click here.

Six Sigma: This term is always popping up in defense related publications and presentations. There are a lot of misconceptions about what it is; another quality system, lean processes, statistical process control, ISO 9000, and more. The reality is that Six Sigma is about making significant business process transformations. It can help companies develop more efficient human resource functions and improve public relations, finance, budget, operations, customer service, information technology, project management, and much more. Earned Value Management Systems (EVMS) - FAC 2005-11 was issued in July and amends FAR to require the use of an EVM system that complies with the guidelines of ANSI-EIA Standard - 748 in major acquisitions for development, and in other acquisitions in accordance with agency procedures. Good news for companies that do not currently have EVM systems - offers shall not be eliminated from consideration because they do not have a compliant system as long as they submit an implementation plan with their proposal. The Depreciation Cost Principle, FAR 31.205-11 was amended by Federal Acquisition Circular (FAC) 2005-10 on June 28, 2006. It affects situations where contractors re-acquire the title to assets that it sold and leased-back. Effective July 28, 2006, allowable depreciation will be based on the net book value of the asset as of the date the contractor originally became a lessee in the arrangement.
